An MP sparked a police investigation after travelling by train from London to Glasgow while testing positive for Covid-19 on Tuesday, 29 September 2020.
On 1 October, the MP self-referred to Police Scotland, informing them that she may have breached Covid rules by travelling while infected. The Metropolitan Police and British Transport Police then collaborated to investigate the matter. The Parliamentary Commissioner for Standards was also notified.
Officers reviewed CCTV footage, test dates, test results, and travel information to verify the MP’s account. The investigation focused on whether the MP had violated Regulation 11(2) of the Health Protection (Coronavirus, Restrictions) (England) Regulations 2020, which requires self-isolation following a positive Covid test.
However, legal experts determined that the key self-isolation rule came into effect only after 28 September 2020. Since the MP’s positive test was taken before 29 September, the regulation did not apply to her case. As a result, no offence was committed.
The Metropolitan Police confirmed that no further action will be taken and that the case has been returned to Police Scotland for their consideration.
Authorities reminded the public to continue following Covid laws and guidelines. “We continue to urge everyone to abide by all legislation and any relevant guidelines to help protect themselves and others,” they said.
